Assistant General Counsel General Purpose Under general supervision, provide legal advice, counsel, representation and analysis to El Paso Water's management, staff and the Public Service Board (PSB) in connection with El Paso Water's legal matters. Represent El Paso Water before a court, administrative agency, or stakeholders in a variety of settings. Minimum Qualifications Juris Doctorate Degree from a law school accredited by the American Bar Association. Licensed to practice law in the State of Texas and eligibility for licensure in Federal court. A member in good standing of the State Bar of Texas. Four (4) years of legal experience as a licensed, practicing attorney, including at least two (2) years in a governmental agency; or four (4) years of legal experience as a licensed, practicing attorney, at least two (2) years in trial and court experience. Valid Class C driver's license from Texas or equivalent from another domestic state. Typical Duties Actively provides legal review, analysis, research and recommendations on the legal risks and strategies associated with resolving claims, disputes, legal actions, and litigation that are filed against El Paso Water. Responsible for all aspects of litigation, including but not limited to discovery, case preparation, tracking and communication of case-related dates, deadlines, and information, and the review and preparation of documents, witnesses, evidence, and correspondence Responds to and resolves sensitive inquiries and complaints from both internal and external sources Prepares pleadings and other papers in connection with lawsuits, trials, hearings and similar legal proceedings; and represents El Paso Water in court, mediation, arbitration, negotiations, conferences, meetings or administrative proceedings. Assists the General Counsel in all department services and activities, including but not limited to civil litigation and preparation of ordinances. Participates in the development of Pewter policies, rules, procedures, projects and programs to ensure conformance with relevant contracts, laws, and rules and regulations. Performs difficult professional and administrative legal work, including major code development or revision, consultation on major departmental problems and projects to assist decision makers with the legal implications of their decisions; draft and negotiate contracts and development agreements to meet the needs and projects of the various departments. Reviews legal documents involving EPWater/PSB including construction contracts, water rights leases, deeds, assignments, resolutions, ordinances and other legal documents. Negotiates, drafts, interprets and reviews complex transactional documents. Assists the General Counsel in rendering legal opinions to the PSB, President/CEO, management staff, and department staff as required; and conducts on-going legal research in connection with pertinent municipal legal issues; and stays abreast of new trends and innovations in the field of municipal law. Attends PSB meetings and takes necessary action regarding agenda items. Advises on open government related issues, including public information and open meetings. Attends and represents EPWater at City Council and other meetings as requested by the General Counsel. Performs related duties and fulfills responsibilities as required. Substitute for coworkers or supervisor during absences. Supervise assigned staff. Knowledge Skills and Abilities Knowledge of pertinent Federal, State, and local laws, ordinances, statutes, and court decisions relating to municipal corporations. Knowledge of operational characteristics, services, and activities of a municipal organization. Knowledge of principles and applications of civil, criminal, and administrative law, judicial procedures, and rules of evidence. Knowledge of methods of legal research and established precedents applicable to municipal activities. Ability to use word processing, spreadsheet, database, and presentation software. Ability to develop, implement, and administer goals, objectives, and procedures for providing effective and efficient services for El Paso Water. Ability to identify and analyze problems, provide alternatives, identify solutions in support of established goals, project consequences of proposed actions, and implement recommendations. Ability to communicate clearly and effectively, both verbally and in writing. Work Environment: This position operates in a professional office environment and requires the use of standard office equipment such as computers, telephones, scanners, smart communication devices, photocopiers, fax machines, and filing cabinets. Work beyond standard workday of 40-hour workweek as necessary. Physical Requirements: Visual acuity, speech and hearing; and eye coordination and manual dexterity necessary to operate a computer keyboard and basic office equipment.
